Honoring Presidents’ Day: The Pillars of Justice and Democracy

On this Presidents’ Day, we reflect on the enduring principles in our Constitution that have shaped our democracy and legal system. Among these, our Founding Framers’ establishment of two particular steadfast principles — an independent judiciary and the right to trial by jury as enshrined in the Seventh Amendment — stand as cornerstones of our Nation’s commitment to justice and fairness.

 

After establishing our Nation’s judicial system under the Judiciary Act of 1789, George Washington wisely stated, “the due administration of justice is the firmest pillar of good Government.” His words serve as a timeless reminder that our Nation’s democracy depends on a judiciary, free from influence, guided only by the law and the pursuit of justice. The Founding Framers understood that without a strong separation of powers and an independent judiciary, the Rule of Law — and the freedoms it protects — would be at risk.

 

As members of ABOTA, we are dedicated to not only upholding the Rule of Law, but also to defending the Seventh Amendment, ensuring that the right to a jury trial in civil cases, in addition to criminal cases, remains a vital safeguard for all citizens. This novel and hard-fought right is not merely a legal principle; it is a fundamental expression of our democratic values, guaranteeing that justice is determined by all the people, not solely the powerful.

 

Today, as we honor the legacy of George Washington and the founders and protectors of our Nation, let us also reaffirm our commitment to protecting these ideals. Thank you for your dedication to the Rule of Law, the right to trial by jury, and the preservation of our democratic institutions.
